Client Responsibilities and Liabilities: Before turning up their project, the client is exclusively responsible for backing up any content (text, multimedia, images, and videos) on their website or mobile app. Any loss or damage to data is not the responsibility of Milkyway Services under any circumstances. As much as we strive to deliver all contracts on time, there may be times when we must extend or adjust delivery times due to unavoidable circumstances such as deployment issues, hosting server issues, 3rd party support, development bottlenecks, resources not being available due to an emergency, communication delays, etc. We will not accept responsibility for any changes made to your website or mobile app after they have been installed or deployed by the client or a third party. Additions, revisions, and removals are examples of such alterations. Before resolving any concerns, we may request a one-time web development and mobile app development charge.
Liability Restrictions:Milkyway Services will provide the services with reasonable competence and care. However, we make no assurance and disclaim any express or implied warranty on the service's availability, quality, accuracy, timeliness, completeness, performance, or fitness.
We release ourselves, our employees, or agents from all and any liability for loss or damage caused by any inaccuracy, omission, delay, or error in the production of the website, mobile application, software application, or the delivery of digital marketing services, whether the result of negligence or other cause. We will not be held accountable for any direct, indirect, or consequential damages in contract or tort, including loss of profit, loss or damage to property, or claims made by third parties.

Requests for Service/Delivery: This Terms Agreement grants you the opportunity to request our services via the Website by completing our Contact Form with your contact information and questions. Our business consultant or salesperson will contact you to answer your questions and follow up on the information you provided. Please evaluate our proposal for that specific service before finalizing any service. You must pay Milkyway Services the fee specified for each service.
Project/Service Delivery: We provide free support for the first-month post the launch of a website or mobile app. After one month of free service, we charge based on the price package best suited to the client's needs. The scope of service only includes bug fixes and email help; it does not include issues with the site architecture, rule modifications, or add-ons/enhancements.
Any third-party support, product, or service used/integrated into the site that requires a license, payment, copyright, etc. shall be the full responsibility and liability of the client and be given by the client or procured by Milkyway Services on behalf of the client for a fee.
All code and website/app developed will be transferred post-completion of the project and after sign-off. The code ownership will reside with the client after the final payments. We reserve the right to publish and use the completed work for references to other potential clients. In circumstances where such is required to be withheld, the client shall notify Milkyway Services well in advance and request prior and proper approval for the same. We try our best to cover up to three changes within the budget of the contract. Some changes are classified as enhancements or add-ons to the project and become chargeable; we will advise you before we start work on any such items. Any rework or changes requested by the client after approval or progressing to the next stage of the project process will be treated as add-on work and billed separately. The client must pay the fee without deductions or discounts by the agreed due dates.
License Restriction:Milkyway Services offers you a non-exclusive, non-transferable license to access and use our Website. Please keep in mind that without prior written approval, you may not frame or otherwise enclose the Website or any portion of it. The limited license granted herein does not include the right to (i) download, change, or modify the Website or its content; (ii) use the Website or its content for any purpose other than personal use; (iii) create any derivative work based on either the Website or its content; or (iv) use our software or take any other action that may place an undue burden on our infrastructure. If we discover any unlawful use of the Website by you, we may terminate the limited license set forth below without prior notice.
